• No Surprises Policy (40 CFR 17) Under this rule, the Services will not seek any form of additional mitigation for a species from a permittee where the terms of a properly functioning conservation plan were designed to provide an overall net benefit for that species and contained measurable criteria or the biological success of the conservation plans which have been or are being met.
